Military DUI Charges Resulting from Off-Base Offenses
In Virginia, it's illegal for a driver to operate a motor vehicle while under the influence of drugs and/or alcohol or when they are driving with a blood alcohol concentration (BAC) of .08 or higher. The law applies to both civilians and military members.
If you're a member of the Armed Forces and were stopped for suspicion of drunk or drugged driving when you were off of the installation, you may be charged under Virginia's laws.
A conviction for a civilian DUI carries various penalties and on the number of previous offenses, as well as the specifics of the circumstances.
For instance, a first offense could result in:
- Confinement in jail for up to 1 year
- Fine of up to $2,500, with a mandatory minimum of $250
- Mandatory driver's license revocation for 1 year
- Ignition interlock device installation for up to 1 year
A second offense within less than 5 years of the first conviction carries:

DUI Offenses Occurring on a Military Installation
If you are arrested on one of the many military bases in Coastal Virginia, you will end up in a Federal Courthouse in Alexandria, Richmond, Newport News or Norfolk. These courts will adopt Virginia law for their DUI cases.
In addition, under the UCMJ, it's illegal for military members to operate or be in physical control of a vehicle, aircraft, or vessel while they're intoxicated or they have a BAC of .08 or more. If you are accused of this offense, you could be subject to a court-martial, non-judicial punishment, or administrative action.
